Privacy Policy

The short version: Capsia does not require an account, does not sell your personal information, and does not use advertising or analytics trackers. Your shopping lists and carts stay on your device. The limited information that does leave your device — a search term, a ZIP code, or (if you allow it) your approximate location — is used only to fetch prices and nearby stores, and is not stored on our servers.

This Privacy Policy explains how Capsia LLC, an Ohio limited liability company (“Capsia,” “we,” “us,” or “our”) collects, uses, and shares information when you use the Capsia mobile application (the “App”), the website located at www.capsia.co (the “Site”), and any related services (collectively, the “Service”). By using the Service, you agree to the collection and use of information as described in this Policy. If you do not agree, please do not use the Service.

1. Information We Collect

We designed Capsia to work without user accounts and to collect as little information as possible. We collect the following categories of information:

1.1 Information you provide

  • Search queries and shopping lists. Product search terms you enter are sent through our servers to our retail data partners to return prices and product information. Your shopping lists, carts, and trip history are stored locally on your device and are not uploaded to our servers.
  • ZIP code / market area. If you enter a ZIP code to select your shopping area, it is used to identify nearby stores and store-specific pricing. Your selected market area is saved locally on your device so the App remembers it between sessions.
  • Email address (Site only). If you sign up for launch updates on the Site, we collect the email address you submit. This form is processed by our website hosting provider on our behalf.
  • Correspondence. If you contact us (for example, at contact@capsia.co), we receive the contents of your message and your contact details.

1.2 Information collected with your permission

  • Device location (optional). If you grant the App location permission, we use your device's location to automatically select nearby stores. Location coordinates are used for the store lookup and are sent to our retail data partners only as needed to identify nearby store locations. We do not store your location on our servers, do not maintain a history of your locations, and do not use your location for advertising. You can use the App without granting location permission by entering a ZIP code manually.

1.3 Information collected automatically

  • Server logs. Like most online services, our servers automatically record limited technical information when the App or Site communicates with them, such as IP address, request timestamps, and general request metadata. We configure our production systems not to log the content of your search queries. Logs are used for security, debugging, and capacity planning, and are retained only for a short period.
  • Local app preferences. Settings such as your selected market area are stored in local storage on your device only.

1.4 What we do not collect

  • We do not require or offer user accounts in the current version of the App.
  • We do not collect your name, payment information, or purchase history.
  • We do not use third-party analytics, advertising SDKs, or cross-site tracking technologies in the App.
  • We do not sell personal information, and we do not share personal information for cross-context behavioral advertising.

2. How We Use Information

We use the information described above to: (a) provide the Service, including returning prices, product matches, and nearby store information; (b) remember your selected market area on your device; (c) send you launch updates or respond to you when you ask us to; (d) maintain the security, reliability, and performance of the Service; and (e) comply with legal obligations. We do not use your information for targeted advertising or automated decision-making that produces legal or similarly significant effects.

3. How Information Is Shared

We do not sell personal information. We share information only in the following circumstances:

  • Retail data partners. To return prices and store information, your search terms, ZIP code, and (if permitted) location coordinates are transmitted to the retailers and licensed data providers whose data powers the Service (for example, retailer product APIs operated by Kroger and Walmart, and licensed third-party pricing providers). These partners process the requests to return results and handle data under their own terms and privacy policies. We do not send them your identity, and the App does not attach account identifiers to these requests.
  • Service providers. We use vendors to host our website, process the email-signup form, and operate our backend infrastructure. These providers process data on our behalf and are not permitted to use it for their own purposes.
  • Legal reasons. We may disclose information if we believe in good faith that disclosure is required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of Capsia, our users, or others.
  • Business transfers. If Capsia is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction. We will notify you of any change in ownership or in the use of your personal information.

4. Affiliate Links and Retailer Referrals

The Service may include links or buttons that open a retailer's website or app (for example, to transfer your basket to a retailer for checkout). When you follow such a link, you leave the Service and the retailer — and, where applicable, an affiliate network — may collect information about your visit under their own privacy policies, including through cookies that attribute your visit to Capsia. We may earn a commission on qualifying purchases made through these links. We do not receive your purchase history from retailers; at most we receive aggregate or anonymized commission reporting. We encourage you to review the privacy policy of any retailer site you visit.

5. Data Retention

  • On-device data (lists, carts, trips, market area) remains on your device until you delete it or uninstall the App. We cannot access or recover it.
  • Email addresses collected for launch updates are retained until you unsubscribe or ask us to delete them.
  • Server logs are retained for a limited operational period and then deleted or anonymized.
  • Correspondence is retained as long as needed to handle your inquiry and for our legitimate record-keeping.

6. Your Choices

  • Location. Location access is optional. You can decline the permission or revoke it at any time in your device settings and use a manually entered ZIP code instead.
  • Email. Every marketing email we send includes an unsubscribe link, and you can ask us to delete your email address at any time by writing to contact@capsia.co.
  • On-device data. You can clear the App's data in your device settings or by uninstalling the App.

7. United States State Privacy Rights

Depending on where you live, state privacy laws (including laws in California, Colorado, Connecticut, Virginia, Texas, Oregon, and other states) may give you rights with respect to your personal information, such as the right to know what personal information a business has collected about you, the right to access it, the right to correct it, the right to delete it, and the right to opt out of sales, targeted advertising, or certain profiling. Some of these laws apply only to businesses above certain size thresholds, which we may not currently meet — but we honor these rights for all users regardless of residence or whether a particular law technically applies to us.

Because Capsia collects so little personal information, most requests are simple: the only personal information we typically hold about you is an email address you gave us and short-lived server logs. To exercise any right, email contact@capsia.co with the subject line “Privacy Request.” We will verify your request using the email address associated with the information and respond within the time required by applicable law. We will not discriminate against you for exercising your rights. You may use an authorized agent to submit a request on your behalf. We do not sell personal information or share it for cross-context behavioral advertising, so there is nothing to opt out of on that front; we likewise do not process personal information for targeted advertising or profiling as defined by those laws.

8. Users Outside the United States

The Service is intended for shoppers in the United States, and the information described in this Policy is processed on servers located in the United States. If you use the Service from the European Economic Area, the United Kingdom, or Switzerland, note that data protection laws such as the GDPR may apply. Where they do: our legal bases for processing are performance of a contract (providing the Service you request), our legitimate interests (securing and improving the Service), and consent (optional location access and email updates, each of which you may withdraw at any time). You have rights of access, rectification, erasure, restriction, portability, and objection, and the right to lodge a complaint with your local supervisory authority. 9. Children's Privacy

The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us personal information, please contact us at contact@capsia.co and we will delete it.

10. Security

We use reasonable technical and organizational measures designed to protect the information we handle, including encryption of data in transit (HTTPS/TLS), restricting the data our servers retain in the first place, and keeping retailer API credentials on our servers rather than in the App. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Changes to This Policy

We may update this Policy from time to time — for example, if we add features such as user accounts, cloud sync, or analytics, each of which would be disclosed here before it takes effect. When we make changes, we will update the “Last updated” date above and, for material changes, provide additional notice in the App or on the Site. Your continued use of the Service after changes take effect constitutes acceptance of the revised Policy.
